General conditions rental agreement ARTICLE 1 - CHARGE OF THE BOAT FOR RENTAL Eurl Eric BARRET undertakes to entrust the Tenant with a Boat equipped and armed in accordance with the laws and regulations in force for the category of navigation. The Owner agrees to rent his Boat in perfect working order and cleanliness, with consumable goods carried out. All the instruments necessary for the navigation and the safety of the Boat and its passengers must be present on board the Boat. The Tenant takes charge of the Boat following the signature of the contradictory inventory of the Boat and when the Owner gives him the keys to the Boat. Subletting and / or lending the Boat is strictly prohibited. Participation in regattas, cruises or any other competitions is strictly prohibited. ARTICLE 2 - CONFLICTING STATE OF THE BOAT Eurl Eric BARRET provides Renters with the inspection of the Boat for information. Each inspection must be carried out in two (2) identical copies, one (1) kept by the charterer and one (1) kept by the Owner. Each copy is signed by the Tenant and the Owner. These are visible, apparent, non-visible and mechanical elements relating to the boat. The Owners and Renters are solely responsible for the construction, assembly, maintenance and inspection of the equipment of the Boat. Likewise, they are not allowed to make a separate inventory of equipment and make unilateral changes. The signature of each contradictory inventory by the Owner and the charterer constitutes an acknowledgment of the condition of the Boat with the exception of hidden defects and normal mechanical failures which may occur during normal use of the Boat. ARTICLE 3 - RETURN OF THE BOAT The Renter must return the Boat to the port of departure where the said Boat was handed over to him, unless specifically requested in the contract. The Renter must return the Boat with all the equipment it contains on the day and time agreed between the parties when booking the Boat. Any delay in returning the Boat is likely to increase the rental price. In this sense, any hour started when the Rental is exceeded is invoiced at the hourly price of the rate in force increased by penalties corresponding to fifty percent (50%) of the hourly rate. In the event of a delay in returning the Boat, the Renter undertakes to notify the Owner. The Renter undertakes to return the Boat and its equipment in the condition in which it received them when taking out the Rental, this concerning in particular its state of operation and cleanliness on the day and at the time specified in the contract for avoid any hourly price increase. The Boat must be returned with the same level of fuel tank as that observed when the Boat was hired. If the level observed during the return of the Boat is lower, Eurl Eric BARRET reserves the right to invoice the difference in fuel level to the tenant. Any deterioration (s) and / or loss (s) noted, even partial (s), of the rented Boat and / or its equipment during the return of the Boat must be indicated in the inventory of fixtures. contradictory delivery of the Boat. This additional deposit must be notified to the tenant before confirmation of the reservation and accepted by the tenant. In case of emergency, contact CROSS (196) (any non-critical request will not be processed). The purpose of the deposit is to guarantee any deterioration and / or loss observed, even partial, of the rented boat which are attributable to the Renter. The amount of the deposit does not constitute any limit of enforceable liability. The Parties retain all power to exercise their rights to exercise any recourse for compensation for the damage suffered. Without a complaint from the Owner, the deposit is automatically released within forty-eight (48) hours from the return of the Boat. ARTICLE 5 - USE OF THE BOAT By default, the Renter is declared as the Captain of the Boat. As such, he is responsible for both the Boat and its equipment and passengers, in accordance with the laws and regulations in force. The Renter is entitled to appoint any other person as the Captain of the Boat. In this case, the name of said person must be indicated in the Rental Contract of the Boat. As for the boat, the skipper is subject to the following obligations: have a valid sea license corresponding to the navigation area be able to pilot the rented boat; assure the Owner of his maritime knowledge; ensure the responsibility of a ship, its equipment and its passengers; be able to lead a crew; embark only the number of people authorized; use the Boat for pleasure navigation within the framework of the legislation in force; not to carry out, using the Boat, any trade, professional fishing, transport, regatta or other operation. If the owner considers that the designated skipper, whoever he is, does not have the proper skills to take charge of the Boat or to ensure the safety of the Boat and / or its passengers, he is unilaterally entitled to cancel the Boat reservation or not complete the Boat Rental. ARTICLE 6 - DAMAGE OR LOSS In the event of damage (s) and / or loss (s) of material incurred during the Rental, the Tenant and / or the skipper must: if the damage or loss is slight and does not prevent the continuation of the Rental or the cruise: have the damaged, lost or missing equipment repaired or replaced, provided that the expense does not exceed thirty euros (€ 30); if the damage or loss is greater and / or prevents the continuation of the Rental: the tenant must immediately contact the Owner to receive instructions that he must follow exactly. Under no circumstances can the loss of use of the Boat due to damage or bad weather give rise to compensation for the benefit of anyone. ARTICLE 7 - CONSUMABLES The lessee is responsible for: motor fuels, lubricants, cooking fuels, electric batteries, and all consumable materials necessary for the proper functioning and maintenance of the boat during the rental period. ARTICLE 8 - DISPUTES In the event of a dispute, the Owner and the Tenant undertake to work together to find an amicable solution. If the Owner and the Tenant fail to find common ground, said dispute will automatically be submitted to the competent courts for assessment. ARTICLE 9 - APPLICABLE LAW AND LANGUAGE These Eurl Eric BARRET General Rental Conditions are subject to French law, which is the only one applicable in this area.
