Article 1: Reservations Passengers must book their service in advance. Any particular health condition must be declared at the time of booking as provided in article 6-2. Pregnant women and people with disabilities, physical or health problems of any kind are required to report this at the time of booking. It is best to book as early as possible, given the limited number of seats on board the ship and the crowds, especially during the high season. We accept online bookings through GetMyBoat. Any reservation without immediate payment can only be validated after providing a credit card imprint and valid contact details. In any event, the customer will be required to pay for his ticket following this reservation under the conditions referred to in article 4 hereof. Booking the BBQBOAT is possible with and without a take-away meal plan as detailed on the site. If you book the BBQBOAT with one of the various packages, you agree to pay the company at the time of booking. Any modification or cancellation in the choice and/or number of packages must take place no later than 48 hours before the date of the service. Otherwise, their amount will be invoiced in full to the customer. Children under the age of three are not allowed on board our ships except on the BBQBOAT (under the full legal responsibility of a parent). Animals are not allowed on board. Any reservation made and confirmed will result in an official reservation confirmation to the customer by email or SMS. Article 2: Schedules, formulas and prices of Services The company offers its passengers several services during the day, at different rates. The schedules and formulas of services are defined by our company. The prices of the services include all taxes included (TTC). Passengers will know the schedules, formulas and prices, at the time of their reservation via the website or after contacting the Company for information. However, the departure and arrival times announced at the time of booking may be advanced or delayed in the event of any difficulty encountered by the captain of the ship. In addition, weather conditions may force the captain of the ship to modify the circuit of the excursion originally planned. If necessary, the price of the excursion will be adjusted. In any event, passengers will be kept informed of any changes in schedules, prices, tours, or formulas. Under no circumstances can such a modification justify the payment of any compensation to passengers. The service provider reserves the right, at the discretion of the Captain and for reasons inherent to navigation, to make stops other than those planned or to modify the route originally planned. The captain is allowed to tow, to rescue ships in all situations, to divert, to do all rescues and all transshipments. Neither the Captain nor the Company can be held responsible for diversions, modifications, interruptions of services or delays in the departures and arrivals of the ship, nor for the non-coincidence in the arrivals, departures or connections of ships and planes and trains. Article 3: Cancellation 3.1- Cancellation by the Company The company reserves the right to cancel a service, without notice or compensation, in case of force majeure, fortuitous event, bad weather, damage, any malfunction, any malfunction, for safety reasons or for any other legitimate reason. Only the captain of the ship is authorized to judge whether or not the weather conditions allow the excursion to be carried out, always in order to allow passengers to enjoy a visit in the best possible conditions. If the departure of the ship is prevented or delayed by any of these exceptional events, the company declines all responsibility for direct or indirect costs and damages caused to passengers. Compagnie du Bateau undertakes to notify passengers as soon as it is aware of the slightest difficulty modifying or preventing the provision of a service. The company will endeavour to offer passengers an alternative and in particular, the delay of the excursion, depending on the availability of the company, or the replacement of the boat, without them being able to claim any compensation, reimbursement or compensation. In the absence of an alternative solution proposed, the passenger may request the reimbursement of the totality of the service from the Company. Refunds are made using the same payment method used by the passenger when booking. 3.2- Cancellation by the passenger and/or tenant The passenger has the possibility to cancel his reservation for any reason and at any time. However, he can only be partially refunded (50%) or exempt from paying for his ticket if the cancellation is made at least 2 weeks before the departure day of the excursion. Otherwise, the passenger will be required to pay for his ticket in full and the Company will not be required to provide any refund or compensation. 3.3-Group Cancellation A group has the possibility to cancel its reservation for any reason and at any time . However, he can only be partially refunded (50%) or exempt from paying for his ticket if the cancellation is made at least 2 weeks before the departure day of the excursion. Otherwise, the passenger will be required to pay for his ticket in full and the Company will not be required to provide any refund or compensation. However, if the company succeeds in re-renting the boat or the service booked, for the same period, the entire deposit may be refunded. Article 5: Validity and non-transferability of contracts Service contracts are issued and valid for the season of the current year. A valid service contract is dated for the service period. They are not transferable. Article 6: Boarding and disembarkation 6.1- Boarding conditions Passengers must present themselves in front of the boarding area 20 minutes before departure, for people without a service contract, 10 minutes before for those with their electronic contract. No delay is accepted by the company. In the event of a delay, even with a contract, the passenger will have no recourse against the company if he cannot board. The boarding and disembarkation of passengers takes place in the presence of the captain, who directs his passengers and tells them how to get on and off board. Only passengers who have reserved their place and present a valid contract are authorized to board. The service contract must be kept in good condition by the passenger for the entire duration of the trip. The company reserves the right to refuse to board a passenger or a group of passengers presenting themselves for boarding without a reservation or without a service contract. The Captain has, among other things, full authority to refuse boarding to anyone with a physical or mental condition that does not allow him to perform the service or to any person who has absorbed narcotics, hallucinogens, or alcohol making his behavior dangerous for towards other passengers. In all cases listed above, the passenger will not have the right to evade liability in the event of damage caused to his own person, to the vessel, to property and equipment, to third parties as well as to the property of third parties . 6.2-Health condition of passengers Any particular health condition must be declared at the time of booking. In addition, any passenger with a disability, a proven health problem, or physical conditions that are incompatible with the service offered (pregnant woman, passenger with a back problem, person with reduced mobility or with a severe disability, or a high heart condition, etc.) is required to report this to the company at the time of booking, as indicated in article 1. In the event of non-declaration at the time of booking, the Captain may refuse boarding to passengers whose health condition is not compatible with the service without requiring reimbursement or compensation of any kind whatsoever from the passenger. The captain is not required to board a passenger who did not mention his condition under these conditions. This passenger will still be required to pay for his reservation and no refund or compensation can be made. In addition, if the captain considers that the health or physical conditions of the passenger who has validly reported himself are incompatible with the walk in view of the weather conditions of the day, he is entitled to refuse the passenger's boarding. If applicable, the passenger will be reimbursed in full. 6.3-Accessibility This type of boat is incompatible with the transport of persons with reduced mobility or with severe physical disabilities. In the event of non-declaration at the time of booking, the Captain has, among other things, all competence to refuse boarding to passengers whose disabilities are not compatible with the service without being able to require reimbursement or compensation of any kind whatsoever, as defined in article 6.2. Bicycles, prams, pushchairs even when folded, motorcycle equipment, or other equipment that is too bulky are not allowed on board and cannot be taken on board. 6. 4-Take charge and inventory of the boat Our company aims to provide the tenant with a boat equipped and armed in accordance with the regulations in force for the intended navigation category, and in perfect working and clean condition . Taking charge of the boat by the tenant is considered done when the balance of the price has been paid, the deposit paid and the inventory signed. The signature of the inventory by the tenant constitutes recognition of the good working condition of the boat with the exception of hidden defects. Any failure to comply with the inventory must be noted jointly by the customer and the rental company and be consistently mentioned in the dedicated document. Failure to sign the inventory by the lessee or failure to deliver the signed inventory to the lessor constitutes acceptance of the boat in working order and complete according to the standard inventory recorded at the lessor's office. In the event of a dispute, only this standard inventory will be binding. Article 7: Safety instructions and responsibility 7. 1-Safety instructions The captain is the sole master on board his ship and informs the passengers of the safety instructions to be respected . Passengers are required to remain seated in their seats while navigating. They will only be able to move on board the ship with the authorization of the captain. Cigarettes, even electronic cigarettes, are prohibited on board company ships. Minors are allowed on board if they are accompanied by their parents and remain under the full supervision and responsibility of their parents. Animals are not allowed on board. 7. 2-Responsibility Passengers undertake in all cases to comply with the regulations established by the Corsica Groom Boat Company on board the ships, as well as to submit to the orders of the Captain . In the event of an accident related to the non-compliance by passengers with safety instructions, the Company cannot be held responsible for any damage that may occur. Passengers are required to keep their personal items with them. The company is not responsible for the objects on board, the degradation of goods and personal effects (jewelry, precious metals, personal papers and documents, sound or image reproduction devices, mobile phones and glasses). In the event of theft, loss or deterioration of these, no compensation, refund or compensation will be made. The tenant is required to check the condition of the boat upon departure, during an inventory. No claims will be possible after departure. For the rental of a boat without a license, the tenant certifies that the captain has the necessary capacities to take charge of navigation and enforce the safety regulations of the entire crew. These will be indicated to you during the departure briefing and will be left available in the boat. The captain is appointed when the contract is signed, and before the boat is made available, by the customer signing the contract. He will be the sole contact person of the lessor for the duration of the rental. He will be particularly in charge of learning about and complying with the safety rules that must be respected during the time the BBQBOAT is rented . The latter must commit himself, both personally and in the name and on behalf of the Customer. The captain must be of legal age and undertake not to drink alcohol or consume drugs for the duration of the rental in order to be in full possession of his means to pilot the boat safely (The regulations are the same on the water as on the road). It is also strictly forbidden to dump waste, of any kind whatsoever, into water under penalty of a 2nd class fine, in accordance with the provisions of articles R541-76 of the Environmental Code and R632-1 of the Penal Code. The signing client must provide the company with a copy of his identity document, as well as that of the captain if different, as well as a telephone number on which he undertakes to be reachable during the duration of the service. BBQ BOATS offer 9 seats and can therefore accommodate up to 9 people maximum. A minimum of 2 adults will be required on board the boat for safety reasons. Children or babies occupy a place in their own right, so they will have to be counted when you book. The Customer must scrupulously respect the navigation perimeter established during the briefing. The lessor cannot be held responsible in the event of an accident occurring due to non-compliance with safety regulations. In the event of non-compliance with the provisions of this article, the Lessor reserves the right to immediately end the service before the scheduled term, without the possibility of reimbursement. In the event of a failure of the boat and its equipment, not due to an error by the Customer, the Renter undertakes to provide assistance as soon as possible. In the event of damage or accident, the captain undertakes to notify the Lessor after ensuring the safe stabilization of the vessel, and not to carry out any repair himself. 7. 3-Attention A deposit will be paid upon boarding, by bank imprint and its amount is fixed at €1,000 . This amount does not in any way constitute a limit of the customer's liability. In the event of an accident, incident, deterioration, loss, loss, theft, poor maintenance of the boat and/or its equipment, abandonment or late return of the boat, caused by the tenant, we reserve the right to withhold the amount of the security deposit in part or in full, or will pay the guarantor the amount of repairs or intervention. As such, the customer undertakes to pay the lessor the repairs of any damage that may have been caused to the boat and/or its equipment and that would be observed during the completion of the contradictory inventory established during its return. The assessment of the amount of damage will be evaluated by the lessor, assisted by a professional in the sector, according to his needs. After evaluating the total amount of the work (spare parts, labor, costs of installing and draining water, security, etc.) and transmission to the customer; The latter may obtain a refund of the amount of the deposit by full payment of the estimate of the work to the lessor. The deposit will then be returned and not taken . If the client disputes this assessment, he may request the expertise of a third party, at his expense, in any circumstances. As such, for damages or losses that may be covered by insurance, the deposit will be retained in full by the Lessor until paid by the insurance company. Reimbursement will be made by deduction of the amounts applicable to the insurance deductible and any expenses and accessories that may have resulted from the claim (administrative costs, reports, intervention by a third party, etc.). If the condition of the boat at the time of its return is satisfactory and in accordance with the initial state of affairs, the amount of the deposit is returned to the Customer, no later than 30 days after its return date. Any repatriation or towing costs will be borne by the Customer. Article 8: Swimming Our company is not a diving or snorkeling club . However, it does offer swimming breaks during its excursions. Swimming will be carried out under the responsibility of the passengers. The captain reserves the right to cancel a swim break due to weather conditions. Passengers undertake in all cases to comply with the regulations established by our company on board ships, as well as to submit to the Captain's orders. Article 9: Stopovers The Ship is required to offer stops to its passengers during excursions . The Company is not responsible for passengers and their personal effects during these stops. No loan of swimming equipment is provided during these stops. The Company cannot be held responsible in the event of difficulty encountered by passengers in a business or establishment during the stopover. The captain may indicate to the passengers an end time of stopover and return to the ship, if he considers it necessary in view of the weather conditions, or not, in order to ensure a safe return to port. In this case, passengers must be in front of the ship 5 minutes before the departure time indicated by the captain. No refund or compensation can be required from a passenger who was unable to board due to a delay. Article 10: Ship regulations Our boats are subject to European regulations relating to the transport of passengers. Navigation permit, renewed after annual inspection, attesting to the vessel's compliance with technical standards relating to the safety of passenger ships (stability, buoyancy, solidity, fire prevention and extinguishing, fire fighting, rescue equipment, etc.). The captain has a command and chief engineer certificate. These Patents also require the possession of a first aid training certificate, and a CRO certificate (Radio Operator Certificate). Every seafarer is required to undergo an annual physical fitness medical examination carried out by a seafarer's doctor. Special insurance covers the boats, their equipment, as well as the liability of participants towards third parties in the event of a disaster. Our captains have skipper liability insurance. Article 11: Groups, Agreements and Privatization. 11.1-Conditions The reservation of a privatized service, or for a group, will only be effective after acceptance of the quotation by the customer as well as after payment of a deposit equal to 40% of the total amount of the service. Payment of the remaining amount will be made at the latest before boarding. In the event of cancellation by the customer, the amount of the deposit remains due to the company and the customer will not be able to claim any refund or compensation. In the event of cancellation by the company under the conditions described in article 3.1, the total amount will be refunded to the customer.
