BOAT RENTAL TERMS & CONDITIONS These Boat Rental Terms & Conditions apply to all bookings made through GetMyBoat and constitute a binding agreement between the boat owner (“Owner”) and the renter (“Renter”). 1. Booking & Payment All bookings and payments are processed through the GetMyBoat platform. The full rental amount is charged at the time of booking in accordance with GetMyBoat policies. 2. Security Allowance (Deposit & Fuel Charges) A security allowance may apply as stated in the listing. No amount is pre-authorized or blocked prior to the trip. The security allowance may be used to cover, including but not limited to, damages, loss, excessive cleaning, late return, violations of these terms, groundings, propeller damage, and fuel shortages. The boat must be returned with the same fuel level as at departure. If returned with less fuel, the Renter authorizes the following charges through GetMyBoat: - Refueling service fee: USD $75 - Fuel cost: USD $7 per gallon, based on the amount required to refill to the original level Fuel levels at departure are documented and considered final. 3. Use of the Boat & Legal Requirements The boat is for recreational use only unless otherwise stated. The Renter agrees to: - operate the boat safely and responsibly - comply with all federal, state, and local boating laws - ensure only qualified, sober persons operate the vessel - not sub-rent or allow unauthorized operators Boater Safety Requirement: Renters born after January 31, 1988 must possess a valid Boater Safety Card or U.S. Coast Guard–recognized Boating License and present it upon request. Navigation Restrictions (Critical – Shallow Waters): When operating inshore, the boat must remain within marked waterways at all times and operate strictly between navigational markers. Local waters are shallow. Leaving marked channels significantly increases the risk of grounding and damage. 4. Groundings, Propeller & Underwater Damage (Strict Liability) Any grounding, propeller strike, skeg damage, lower unit damage, or contact with sandbars, rocks, coral, or the bottom is the sole responsibility of the Renter, regardless of fault or conditions. This includes, but is not limited to: - propeller repair or replacement - lower unit or drivetrain damage - hull, rudder, or shaft damage - towing, haul-out, inspection, and loss of use Insurance coverage does not eliminate the Renter’s liability, including deductibles, exclusions, or uncovered damages. 5. Weather & Owner’s Right to Cancel The Owner reserves the right to cancel or modify the trip due to mechanical issues, unsafe conditions, or adverse weather. If the Owner cancels, a full refund will be issued via GetMyBoat. 6. Insurance The vessel may be insured as required by law. The Renter remains fully responsible for damages up to and beyond any deductible or excluded amount. 7. Return of the Boat & After-Hours Policy The boat must be returned on time and in substantially the same condition as received. After-Hours Returns: If the boat is returned outside of business hours, the Renter must: - place the key inside the battery switch compartment, and - take a clear photo of the fuel gauge at the time of return. Final Inspection & Risk: The final inspection and acceptance are always performed by the Captain. For after-hours returns, all risk remains with the Renter until the Captain completes the final inspection. The final determination of fuel level and condition is made solely by the Captain. For this reason, returning the boat in person during business hours is strongly recommended. 8. Limitation of Liability The Owner is not responsible for personal belongings, injuries, or damages resulting from improper, unsafe, or unlawful use of the vessel. 9. Governing Law This agreement is governed by the laws of the state in which the rental takes place. 10. Acceptance of Terms By completing a booking on GetMyBoat, the Renter confirms that they have read, understood, and agreed to these Terms & Conditions.
