Last updated: November 2025 1. Booking & Payment A full payment is required to confirm your booking, this will be collected by GetMyBoat. 2. Cancellations & Refunds More than 5 days’ notice: Full refund of deposit.. 5 or less days’ notice: 50% refund (unless we are able to rebook your date). Cancellations must be made in writing via email. If weather or safety conditions require cancellation by the skipper, you may choose to reschedule or receive a full refund. 3. Weather & Safety Safety is our top priority. The skipper has sole discretion to cancel, postpone, or alter the charter route or schedule if conditions are unsafe or unsuitable. Charters may continue in light rain or cloudy weather; cancellations occur only when conditions are deemed unsafe by the skipper. Passengers must follow all safety instructions from the skipper at all times. Lifejackets and safety gear are provided onboard. 4. Guest Conduct The charterer is responsible for the conduct of all guests. The skipper may terminate the charter early if guests behave in a reckless, unsafe, or abusive manner or if alcohol consumption leads to unsafe conditions. Illegal substances, smoking inside the cabin, or excessive intoxication are strictly prohibited. Damage to the vessel, its equipment, or fittings caused by guests will be charged to the charterer. 5. Capacity & Children Maximum of 4 guests onboard (including children). Children are welcome but count toward the guest limit. Please advise ages at booking so suitable lifejackets can be provided. The charterer must ensure children are supervised at all times. 6. Food, Drinks & Catering BYO food and drinks are welcome. Use of the onboard BBQ is permitted under supervision. Microwave, fridge, and freezer are available for guest use. The skipper reserves the right to restrict alcohol consumption if it impacts safety. 7. Pickup & Drop-off Standard departure point: Cabarita Wharf. Alternate wharves (e.g., King Street Wharf, Rose Bay, Double Bay) may be arranged for an additional wharf fee (typically $50–$80 each way), charged at cost. Wharf times are set by Transport for NSW. Late arrival by guests may reduce total cruise time. 8. Liability & Indemnity Opal Escape Charters maintains appropriate marine public liability insurance. Passengers board and participate at their own risk. To the extent permitted by law, we are not liable for any injury, loss, or damage arising from the charter, except where caused by our negligence. Guests are advised to bring minimal valuables; we accept no responsibility for loss or damage to personal property. 9. Damage, Cleaning & Additional Fees A cleaning fee may apply if the vessel requires excessive cleaning due to spillage, food waste, or other mess. Any damage caused by misuse or negligence will be charged to the charterer at repair cost. Unscheduled return to wharf due to guest conduct or late departure does not entitle the charterer to compensation. 10. Photography & Media We may take general photographs or videos of the vessel for promotional use. If you do not wish to appear in any marketing material, please notify us in writing before your charter. Guests are welcome to take personal photos and videos. 11. Force Majeure We are not liable for delays or cancellations due to events beyond our control, including severe weather, equipment failure, government restrictions, or emergency conditions. 12. Agreement By confirming a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
