Jet Ski Rental Agreement, Release of Liability, and Waiver 1. Use and Responsibility Lessee agrees to: - Operate the jet ski safely and follow all applicable local, state, and federal boating laws. - Allow only authorized users (18 years or older) to operate the jet ski. - Accept full responsibility for the jet ski and trailer during the rental period. 2. Assumption of Risk Lessee understands that jet ski operation involves inherent risks, including but not limited to bodily injury, property damage, and death. By signing this Agreement, Lessee voluntarily assumes all such risks and releases Lessor from any liability associated with their use or operation of the jet ski. 3. Waiver and Release of Liability Lessee hereby releases, waives, and discharges Lessor, its owners, employees, agents, and insurers from any and all liability, claims, actions, or causes of action for injury, damage, or loss, including death, sustained by Lessee or any third party arising from the use or operation of the jet ski, regardless of fault or negligence. 4. Damages and Additional Charges Lessee agrees to be financially responsible for the following, as applicable: - Damage to the jet ski or trailer - Missing/lost equipment (life jackets, fire extinguisher, tie-downs, etc.) - Fuel refill: $40 flat fee + cost of gas if not returned full - Late return: $75 per each 30-minute interval - Cleaning fee: Up to $250 if returned excessively dirty - Towing assistance: $150/hr before 5 PM, $200/hr after 5 PM Lessor reserves the right to assess damages within 48 hours of return. Charges may be deducted from the $800 security deposit or charged to the card on file. 5. Insurance and Indemnification Lessee acknowledges that no insurance coverage is provided for their use. Lessee assumes full liability for any injury, damage, or loss incurred and agrees to indemnify and hold harmless Lessor from any claims, lawsuits, losses, or legal expenses arising from the rental. 6. Cancellations and No Shows - Cancellations made less than 5 days before the rental date are non-refundable. - No-shows or arriving over 1 hour late without contact may result in cancellation with no refund. 7. Return Inspection Lessee agrees to allow a post-rental inspection within 48 hours. Lessee is encouraged to take time-stamped photos/videos of the jet ski and trailer before use to document pre-existing conditions. 8. Prohibited Use Lessee may not: - Operate under the influence of drugs or alcohol - Tow persons or objects without written approval - Overload the jet ski (Max capacity: 450 lbs) - Operate in water less than 3 feet deep - Beach the jet ski - Operate after sunset Violation of any of these terms may result in immediate termination of rental and forfeiture of all fees. 9. Permits, Fees, and Legal Compliance Lessee is responsible for: - Obtaining and paying for all necessary permits, inspections, and launch fees - Any fines, tickets, or citations related to:   • Lack of boating licenses or safety certifications   • Speeding, reckless operation, or violating boating laws   • Improper trailering or failure to comply with ramp/inspection rules Lessee agrees to indemnify Lessor for any legal costs, citations, or claims incurred during the rental period. 10. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada. Any disputes will be subject to the exclusive jurisdiction of the courts located in Washoe County, NV. 11. Acknowledgment and Consent I certify that: - I have read and understand all terms and conditions - I understand the risks associated with jet ski operation - I voluntarily assume full responsibility and waive all claims against the Lessor - I agree to all financial and legal obligations set forth
