Jet Ski Rental Agreement, Release of Liability, and Waiver 1. Use and Responsibility Lessee agrees to: - Operate the jet ski safely and follow all applicable local, state, and federal boating laws. - Allow only authorized operators 18 years of age or older to operate the jet ski. - Accept full responsibility for the jet ski, trailer, and all included equipment during the rental period. 2. Assumption of Risk Lessee understands that jet ski operation involves inherent risks including but not limited to bodily injury, property damage, collision with other vessels, drowning, and death. By participating in this rental, Lessee voluntarily assumes all risks associated with the operation and use of the jet ski. 3. Waiver and Release of Liability Lessee hereby releases, waives, and discharges the Lessor, its owners, employees, agents, and insurers from any and all liability, claims, demands, actions, or causes of action for injury, damage, or loss, including death, sustained by Lessee or any third party arising from the use or operation of the jet ski, regardless of fault or negligence. Lessee assumes full responsibility for all individuals operating or riding on the jet ski during the rental period. 4. Insurance and Indemnification Lessee acknowledges that no insurance coverage is provided for their operation of the jet ski. Lessee assumes full liability for any injury, damage, or loss incurred during the rental period and agrees to indemnify and hold harmless the Lessor from any claims, lawsuits, damages, losses, or legal expenses arising from the use or operation of the jet ski. 5. Security Allowance Bookings made through the Getmyboat platform are subject to Getmyboat’s payment and damage claim policies. An $800 security allowance is associated with this rental. This amount is not charged at booking, but may be charged to the renter’s credit card by Getmyboat if a valid claim is submitted for: - damage to the jet ski or trailer - missing equipment - cleaning fees - fuel charges - late return fees - towing assistance - citations or other costs incurred during the rental period Claims may be submitted within 48 hours after the rental period ends. 6. Pre-Rental Condition Verification Lessee acknowledges that the jet ski, trailer, and all included equipment have been inspected and accepted in good operating condition unless otherwise documented. Lessee agrees to review the condition of the equipment prior to use and notify Lessor immediately of any concerns before leaving the pickup location. Failure to report damage prior to departure constitutes acceptance of the equipment in its present condition. Any new damage discovered after the rental period will be presumed to have occurred during the rental unless otherwise documented. 7. Damages and Additional Charges Lessee agrees to be financially responsible for the following, as applicable: - Damage to the jet ski or trailer - Missing or lost equipment (life jackets, fire extinguisher, tie-downs, etc.) - Fuel refill: $40 service fee plus cost of fuel if not returned full - Late return: $75 per 30-minute interval (rounded up to the next 30-minute period) - Cleaning fee: Up to $250 if returned excessively dirty - Towing assistance: $150 per hour before 5 PM, $200 per hour after 5 PM Damage resulting from operator negligence, including shallow water operation or ingestion of debris into the jet pump, will be the responsibility of the Lessee. Lessee agrees to compensate Lessor for loss of rental income resulting from damage that renders the jet ski unavailable for future rentals. 8. Mechanical Damage Responsibility Jet skis operate by drawing water through an intake grate and jet pump. Operating in shallow water, near shorelines, beaches, ramps, or areas containing sand, rocks, or debris may cause damage to the impeller, wear ring, or cooling system. Damage resulting from: - operating in water less than 3 feet deep - beaching the jet ski - ingesting sand, rocks, or debris will be considered operator negligence and will be the financial responsibility of the Lessee. 9. Prohibited Use Lessee may not: - Operate under the influence of alcohol or drugs - Tow persons or objects without written approval - Operate recklessly or negligently - Overload the jet ski (Max capacity: 450 lbs) - Operate in water less than 3 feet deep - Beach the jet ski - Operate after sunset Violation of these terms may result in immediate termination of the rental and forfeiture of all rental fees. 10. Return Inspection and Documentation Lessee agrees to allow a post-rental inspection within 48 hours of return. Lessor may document the condition of the jet ski and trailer with photographs or video before and after the rental. These records may be used to support any damage claims submitted through the rental platform. Lessee is encouraged to take time-stamped photos or videos prior to use to document pre-existing conditions. 11. Cancellations and No Shows - Cancellations made less than 7 days before the rental date are non-refundable. - No-shows or arrivals more than 1 hour late without communication may result in cancellation with no refund. 12. Personal Property Lessor is not responsible for any personal belongings that are lost, damaged, or stolen during the rental period. 13. Boating Law Compliance and Permits Lessee agrees to comply with all applicable local, state, and federal boating laws and regulations. Lessee confirms that all operators meet the legal requirements of the state in which the jet ski is operated, including minimum age requirements and any required boating safety certifications. Examples include but are not limited to: - Nevada: Boater Education Card required for operators born after January 1, 1983 - California: California Boater Card required for operators of motorized vessels Lessee is responsible for obtaining and paying for all required permits, inspections, and launch fees. If operating on Lake Tahoe, Lessee must obtain any required Aquatic Invasive Species (AIS) inspections and seals prior to launching. Lessee is solely responsible for any citations, fines, impound fees, or penalties incurred during the rental period. Lessee agrees to indemnify Lessor for any legal costs, citations, or claims incurred during the rental period. 14. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Washoe County, Nevada. 15. Capsizing and Restart Procedure If the jet ski overturns or capsizes, it must be returned to the upright position following the manufacturer’s indicated roll direction shown on the rear of the vessel. Attempting to start the engine after water has entered the engine compartment may cause severe engine damage. If the jet ski capsizes and does not restart normally, the operator must stop attempting to restart the engine and contact the Lessor immediately. Any engine damage resulting from improper restart procedures following capsizing may be considered operator negligence and the financial responsibility of the Lessee. 16. Weather and Water Conditions Lake conditions may change rapidly due to wind, weather, and boat traffic. Lessee agrees to operate the jet ski responsibly and return to shore if conditions become unsafe. Lessor is not responsible for interruptions, delays, or cancellations caused by: - weather conditions - lake conditions - mechanical issues beyond the Lessor’s control - government or marina restrictions Refunds or schedule adjustments may be issued at the Lessor’s sole discretion. 17. Acknowledgment and Consent By completing this rental, Lessee certifies that: - They have read and understand all terms and conditions - They understand the risks associated with jet ski operation - They voluntarily assume full responsibility and waive all claims against the Lessor - They agree to all financial and legal obligations set forth in this Agreement
