Acceptance of Terms By booking a tour with us! Madeira, you agree to these Terms and Conditions. Please read them carefully before making a reservation. Bookings and Payments 1. Reservations: All bookings must be made through our website or by direct contact. 2. Payment: Full payment is required at the time of booking. We accept PayPal, Multibanco, and MBWay. 3. Confirmation: You will receive a booking confirmation via email with all tour details. Cancellation Policy 1. Weather Cancellations: If we cancel a tour due to adverse weather conditions or safety concerns, you will receive a full refund or can reschedule at no additional cost. 2. Customer Cancellations: - More than 48 hours before departure: Full refund minus 10% administrative fee - 24-48 hours before departure: 50% refund - Less than 24 hours before departure: No refund 3 No-Show: Failure to appear for your scheduled tour without prior cancellation will result in full forfeiture of payment. Tour Modifications We reserve the right to modify tour itineraries or schedules for safety, weather, or operational reasons. In such cases, we will offer an alternative tour or full refund. Participant Requirements 1 Age: Children under 18 must be accompanied by an adult. 2 Health: Participants must be in reasonable physical condition. Please inform us of any medical conditions that may affect your ability to participate. 3 Pregnancy: Pregnant women should consult their doctor before booking. 4 Capacity: Maximum capacity is 8 passengers per tour. Safety and Behavior 1 Instructions: All participants must follow the skipper's safety instructions at all times. 2 Equipment: Life jackets and safety equipment are provided and must be worn when required. 3 Conduct: We reserve the right to refuse service or terminate a tour if a participant's behavior endangers safety or disrupts the experience for others. No refund will be provided in such cases. 4 Alcohol: Excessive alcohol consumption is not permitted and may result in tour termination. Liability 1 Insurance: All tours are covered by liability insurance as required by Portuguese maritime law. 2 Personal Belongings: We are not responsible for loss, damage, or theft of personal items. 3 Limitation: Our liability is limited to the amount paid for the tour, except in cases of gross negligence or willful misconduct. 4 Assumption of Risk: Sailing involves inherent risks. By participating, you acknowledge and accept these risks. Photography and Marketing We may take photos and videos during tours for marketing purposes. By booking, you consent to the use of such media. Please inform us if you do not wish to be photographed. Force Majeure We are not liable for failure to perform our obligations due to circumstances beyond our control, including but not limited to natural disasters, strikes, or government restrictions.
