SUMMARY OF THE RENTAL CONDITIONS CONFIRMATION The rental agreement must be completed and signed by the tenant within 5 days, together with a copy of the boating license if requested, and returned to the lessor. LIABILITY The tenant does not hold the lessor liable for any personal or material damage suffered by the tenant. The tenant does not hold the lessor liable for any claims made by third parties. TERMINATION OF THE RENTAL AGREEMENT The lessor reserves the right to take a mandatory SSH course and/or to terminate the rental agreement immediately if the tenant proves to be incompetent with regard to sailing and/or navigating the vessel, without the lessor being liable to pay any compensation and/or refund the rental amount to the tenant. AVAILABILITY The tenant must identify himself to the lessor before departure by means of an identification document (e.g. passport or driver's license). The vessel is made available clean and with full water, gas and fuel tanks. The tenant is obliged to pay the rent and deposit due, or cancellation costs, even if he does not use the vessel or uses it for a shorter period. RETURN At the end of the rental period, the renter must refuel the vessel at the lessor. The renter must return the vessel to the home port in good time, before the end of the rental period, in the same condition (except for wear and tear) as at the start of the rental period. The renter must return the boat tidy and swept clean. Any damage that occurs during the rental period must be reported to the lessor by the renter. The damage will be deducted from the deposit. Any material lost during the rental period must be compensated by the renter. SAILING AREA The sailing area includes the insurance area determined by the insurance. Namely: Inland waters of Friesland – Overijssel - Groningen with the exception of the major rivers. and IJsselmeer – Markermeer – IJmeer - Waddenzee – Zwarte meer – Ketelmeer - In the event of violation of the sailing area, the lessor may immediately take possession of the vessel, without refund of the rental fee and withholding the deposit. Extension of the sailing area is only possible if this has been agreed in writing with the lessor. DAMAGE OR BREAKDOWN In the event of any damage, breakdown, damage, seizure and damage to the vessel, inventory and accessories, the renter must contact the lessor as soon as possible. DEFECTS If one of the parties fails to fulfil its obligations, the other party has the right to terminate the contract in whole or in part. This is only different if the deficiencies are of such a special nature or minor extent that termination is not justified. There is also a claim for compensation for any damage, unless the deficiency cannot be attributed to the other party. The lessor's liability for deficiencies is limited to a maximum of the amount of the rental fee paid by the tenant. If the tenant returns the vessel later than agreed, the lessor has the right to a proportional increase in the rental fee and compensation for further damage, unless the late return cannot be attributed to the tenant. APPLICABLE LAW AND DISPUTE RESOLUTION This rental agreement is subject to Dutch law. Only the Dutch court, or the dispute resolution body established in the Netherlands by both parties, is authorized to hear disputes. GENERAL The tenant is not permitted, among other things, unless with the written permission of the landlord: to stay on the ship with more crew members than the number stated on the reservation or rental contract form. To participate in competitions. 15.c to keep pets on board without the express permission of the lessor (additional cleaning costs will be charged for this).
