This Boat Charter Liability Waiver & Release Agreement (“Agreement”) is entered into by the undersigned (“Participant”) in favor of The Tour Operator, its owners, officers, employees, crew members, agents, representatives, successors, and assigns (collectively, “Company”). By signing this Agreement, the Participant voluntarily agrees to the terms and conditions outlined below. 1. ASSUMPTION OF RISK I, the Participant, acknowledge and understand that boating, swimming, snorkeling, diving, and other water-related activities involve inherent risks, including but not limited to: • Drowning, injuries from watercraft operation, falls, slips, and other accidents; • Injuries due to encounters with marine life, including jellyfish, sharks, and other sea creatures; • Exposure to sun, heat, dehydration, seasickness and other environmental conditions; • Equipment malfunctions or failures; • The potential for unpredictable weather conditions and sea states. I voluntarily assume all risks associated with my participation in the boat charter and related activities, whether such risks are known or unknown to me. 2. RELEASE AND WAIVER OF LIABILITY I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and hold harmless the Company from any and all claims, demands, causes of action, damages, or liabilities of any kind arising out of or in connection with my participation in the boat charter, including but not limited to claims of negligence. I understand that this release extends to any injuries (including death), property damage, or other losses that may occur during or as a result of my participation in the boat charter. 3. INDEMNIFICATION I agree to indemnify and hold harmless the Company from any claims, damages, losses, or expenses (including attorney fees) that may arise as a result of my participation, whether caused by my own actions or the actions of others. 4. MEDICAL CONDITIONS & EMERGENCIES I certify that I am physically and mentally fit to participate in this activity. I have disclosed any medical conditions that may affect my ability to safely participate, including but not limited to heart conditions, respiratory issues, pregnancy, or recent surgeries. In the event of a medical emergency, I authorize the Company to seek medical assistance on my behalf. I understand that I am responsible for all medical expenses incurred. 5. SAFETY & CONDUCT I agree to follow all safety instructions and guidelines provided by the Company and its crew. I understand that failure to comply may result in my removal from the activity without a refund. I also acknowledge that alcohol and drug use impair judgment and increase risks, and I accept full responsibility for my actions while under the influence. 6. PHOTO & VIDEO RELEASE I hereby grant The Tour Operator the right and permission to take, use, publish and distribute photographs, video recordings, or other media of me during my participation in the boat charter. I understand that these images may be used for promotional, advertising, and social media purposes without compensation to me. I waive any right to inspect or approve the final product and release the Company from any claims relating to the use of my likeness. 7. CANCELLATION & REFUND POLICY I acknowledge and agree to the Company’s cancellation and refund policy as outlined in the booking terms. I understand that weather conditions, mechanical issues, or other unforeseen circumstances may lead to schedule changes or cancellations, for which the Company is not liable beyond the terms of its stated refund policy. 8. JURISDICTION & SEVERABILITY This Agreement shall be governed by and construed in accordance with the laws of the Bahamas. Any disputes shall be resolved in the courts of the Bahamas.
