1. RESERVATION, FORMALIZATION OF THE CONTRACT AND SECURITY 1.1. It is necessary to present a personal identity document to formalize the contract, as well as the approved nautical license necessary to pilot the boat you want to rent. In the case of a foreign nautical license, it will be valid as long as it is approved in Spain. 1.2. The reservation will be confirmed and guaranteed by paying the full amount of the rental through GetMyBoat together with the deposit. 1.3. The bond will be used to cover any damage, damage or loss caused to the vessel and its equipment, as well as to cover the loss of profits caused by them. 1.4. The deposit will be paid before shipment and will be refunded to the customer within 24 hours after the lease, provided that he confirms that the vessel is in the same state and inventory in which it was delivered. 1.5. Our company will provide you with the rental agreement that you must sign, which contains the detailed rental conditions published here. The signing of such a contract implies acceptance by both parties of the above-mentioned conditions. 2. DELIVERY AND RETURN OF THE VESSEL - 2.1. The boat will be delivered to the lessee in Port de l'Escala at the time established in the reservation document. It is recommended to go to the boarding area 30 minutes in advance to be able to leave at the agreed time. Our team will explain and advise you on the operation of the boat and its accessories. - 2.2. The boat will be delivered with full fuel and water tanks. Fuel is not included in the rental price; once the boat is returned, the fuel consumed will be checked and the lessee must pay it to Our company. Otherwise, we will deduct the fuel consumed from the deposit at a price of 2 €/liter. - 2.3. The delay in the removal of the boat by the lessee for reasons attributable to the lessee will not extend the lease term. In the same way, if weather conditions or other unforeseen circumstances force the tenant to delay the departure, this will not entitle him to a reduction in the agreed price or to the extension of the contract, which will end on the established day and time. - 2.4. Upon arrival, our team will carry out a full inspection of the boat to check its condition and that of all its equipment. It must be in the same condition as it was delivered. The customer will be penalized with 100€ for every 15 minutes of delay, depending on the time established in the contract, provided that such delay has not been agreed in writing with our company in advance for reasons of extended rental hours. The amount will be deducted from the deposit. - 2.5. In the event of material damage, deterioration or loss of material or accessories of the rented boat, our company will have the right to withhold a bond for the consequent damage caused to manage repairs, replace damaged or lost material and cover lost profits. - 2.6.If you have any problems with the operation of the boat or need help docking, please contact us. - 2.7. For problems affecting the safety of passengers and/or vessels, call Maritime Rescue, or contact the portable radio on Channel 16 VHF. 3. SAFE - 3.1. The customer is insured against civil liability against third parties through the contracted policy. - 3.2. Our company includes comprehensive insurance with excess insurance that covers personal and physical damage to the crew as long as all of these are not caused by negligence or misuse of the boat (excluding the engine propeller, chain and anchor). In case of use, the excess will be deducted from the deposit. 4. SAFETY ON BOARD - 4.1. It is essential to carry the mobile phone indicated in the contract on board to be able to contact our company or vice versa in case of emergency. - 4.2. For legal and safety reasons, it is not allowed to exceed the maximum number of people on board that allows the approval of the rented boat. Failure to comply with this rule results in the loss of security. - 4.3. While sailing, it is recommended to wear life jackets and sit in the respective seats of the boat. You cannot enter, stay, or leave the water with the engine running. The permitted navigation area, provided that the skipper's qualification allows it, will be the one specified in the contract. You cannot navigate in an area other than the one indicated without the express authorization of the landlord, and the latter can control it using the GPS tracking device located on the boat. - 4.4. The boat cannot be used to intervene in regattas and/or competitions, nor can it be used for professional fishing, commerce, transport or any economic activity. - 4.5. It is forbidden to tow other boats or allow them to be towed without the consent of our company, except in situations of flagrant emergency. The cost of the rescue will be borne by the tenant, except in the case of mechanical failure that is not their responsibility. - 4.6. Our company will not be responsible for the loss or damage of any personal object lost, stored or transported on the boat during the rental. - 4.7. It is not allowed to rent the boat again or to be driven by people other than those listed in the contract. 5. CANCELLATIONS AND CHANGES - 5.1. The cancellation of the reservation by the customer will involve the processing, management and blocking of the vessel, so any cancellation will result in the non-refund of the amount paid when formalizing the reservation. - 5.2. Our company accepts the change of a reservation by the customer with prior notice, at least 7 days before the rental day. - 5.3. When the rental cannot be enjoyed for weather reasons justified and verified by our company, the customer will be offered a change of date to enjoy the rental another day, subject to the availability of the boat. - 5.4. No changes will be made due to weather conditions until the same day of the rental. Our company will inform you of the weather conditions on the day of your rental. If you decide not to leave, even if the verdict of our staff is positive, our company will not refund the amount paid when formalizing the reservation. - 5.5. If you cannot go sailing due to a personal problem, our company will not be responsible for it, so the amount of the reservation will not be refunded or changed on the day of the rental. - 5.6. Our company offers skipper service for all its ships. It is necessary to notify it at the time of booking so that our company can contact the skipper and confirm availability. The price of the skipper may vary depending on the ship and the season. - 5.7. The fridge rental will always be ice-free.
