Boat Rental Terms & Conditions By booking and operating this vessel, the Renter agrees to the following terms and conditions: Eligibility - The primary renter must be at least 25 years old and possess a valid government-issued photo ID. - The renter must be present for the rental and is responsible for everyone on board. - The renter affirms they have prior boating experience or are comfortable safely operating a wake boat. We reserve the right to deny a rental if we believe operation would be unsafe. Rental Period - Rental time begins and ends at the scheduled times. - Late returns will be charged $100 per every 30 minutes, unless prior arrangements have been made. - No refunds will be issued for late arrivals or shortened rental periods due to the renter. Security Deposit & Damages - A security deposit is required before departure. - The renter accepts full financial responsibility for any damage to the boat, trailer (if applicable), propeller, upholstery, equipment, or accessories caused during the rental period that is not covered by insurance. - Any excessive cleaning, lost equipment, or fuel shortages may be deducted from the deposit. Fuel - Boat is provided with a full tank of fuel. - The renter is responsible for fuel used during the rental and will be charged at the end of the rental if the tank is not returned full (or according to the rental agreement). Weather Policy - Safety is our top priority. - Rentals may be rescheduled or refunded if dangerous weather conditions (lightning, severe thunderstorms, high winds, or lake closures) prevent safe operation. - Light rain, cloudy weather, or cooler temperatures do not qualify for weather cancellations. - Weather decisions are made by the boat owner. Boat Rules The following are strictly prohibited: - Smoking or vaping on the boat. - Illegal drugs. - Operating the boat while under the influence of alcohol or drugs. - Red wine, glass containers, or staining foods/drinks. - Pets without prior approval. - Beaching the boat. - Climbing on the tower or jumping from the tower. - Towing other boats or watercraft. - Exceeding the maximum passenger capacity of 12 persons. Failure to follow these rules may result in immediate termination of the rental without refund. Safety - Coast Guard-approved life jackets are provided and should be worn whenever appropriate. - Children must wear life jackets as required by Utah law. - The renter agrees to operate the vessel in accordance with all local, state, and federal boating laws. - The renter is responsible for ensuring all passengers act safely while aboard. Watersports - Wake surfing, wakeboarding, skiing, and tubing are permitted only in designated safe areas. - A spotter (observer) must be onboard whenever towing a rider, in accordance with Utah law. - Riders participate entirely at their own risk. - The owner assumes no responsibility for injuries resulting from watersports activities. Mechanical Issues - If any mechanical issue or warning light occurs, the renter must immediately stop operating the boat and contact the owner. - Continuing to operate the boat after a known issue may result in additional liability. Accidents & Damage - Any accident, collision, grounding, or damage—regardless of severity—must be reported immediately. - The renter agrees to cooperate with any insurance investigation or required reporting. Cleaning - Normal use is expected. - Excessive dirt, mud, spills, vomit, stains, trash, or other unusual cleaning requirements will incur a minimum $150 cleaning fee. No-Shows & Cancellations - No-shows forfeit the rental payment. - Cancellations made within 72 hours of the rental are non-refundable unless due to severe weather approved by the owner. - Earlier cancellations may be rescheduled or refunded according to the booking platform's policies. Assumption of Risk Boating and watersports involve inherent risks, including serious injury or death. By signing this agreement, the renter acknowledges these risks and voluntarily assumes full responsibility for themselves and all passengers. Liability The owner shall not be liable for injuries, accidents, loss of personal property, or damages arising from the renter's operation or use of the vessel, except where prohibited by applicable law. Indemnification The renter agrees to indemnify and hold harmless the boat owner from any claims, lawsuits, liabilities, damages, costs, or attorney fees arising from the renter's use of the vessel. Personal Property The owner is not responsible for lost, stolen, or damaged personal belongings left on the boat. Owner's Right to Terminate The owner reserves the right to terminate the rental immediately without refund if the renter: - Operates the boat recklessly. - Violates boating laws. - Operates under the influence. - Allows unauthorized operators. - Violates any terms of this agreement. A Few Simple Requests We take great pride in keeping our 2025 Heyday H22 in exceptional condition so every guest has an amazing experience. Please treat it like it's your own: - Remove all trash before returning the boat. - Avoid sharp objects on the upholstery. - Rinse off excessive sand or mud before boarding. - Report any issues honestly—we understand accidents happen.
