PAYMENT OF THE RENTAL PRICE – The payment of the entire price, or, if a deposit has been paid, the balance of the price will be made before the rental or before boarding. To protect the safety of navigation, it is within the skipper’s powers to invite those who behave in an incorrect, dangerous or in any case, inadequate manner for the orderly conduct of the cruise, to leave the vessel. Passengers are required to arrive for boarding thirty minutes before the established departure time. Failure to arrive for boarding by the time established during the booking does not entitle the customer to any refund. In case of doubt, please consult a member of our staff who will be able to provide you with all the necessary information. The owner reserves the right to make changes to programs and/or schedules in the event of any unfavorable weather-sea conditions, force majeure or technical-operational needs. This right does not entitle the customer to any refund. As regards bathing and circumnavigations: visits by sea, circumnavigations and stops in coves are always optional and subject to weather and sea conditions, judged in an unquestionable manner by the Captain of the vessel. Any failure to carry out due to reasons of force majeure or technical operational needs of the cruise or stopover does not entitle the holder to a refund of the ticket, not even partial. It is absolutely forbidden on board to: - • Have behaviors or attitudes that are or could be a cause of disturbance or annoyance to other passengers; - • Tamper with furnishings and equipment on board, - • Wear or keep weapons and ammunition in your luggage. - • Carry inflammable, explosive, corrosive or otherwise dangerous materials in your luggage, as well as cylinders filled with oxygen, compressed air, gas and similar; - • Transport letters and packages subject to postal taxes; - • Throw objects of any kind into the sea. From 6 days before the departure date until the day of the same we will not make any refund except for reasons of just cause (illness, death or serious problems certifying the problem with documentation you will have the possibility of receiving the full refund).In case of bad weather we will ask you if you want to move the tour date (based on our availability) or alternatively be refunded. The tour could be cancelled if the minimum number of passengers is not reached (minimum 8 passengers).No refund is due to those who do not show up at the agreed time for boarding without having given prior notice. WITHDRAWAL BY THE RENTAL COMPANY – For reasons of force majeure or other strictly personal reasons having the requirements of unforeseeably and urgency (for example health problems or adverse sea weather conditions), the renter may withdraw from the contract, giving timely notice to the renter. The renter will have the right, where possible, to propose to the renter an alternative, which is such as not to involve changes to the renter's programs or to vary the means of transport used to reach the embarkation point (and depart upon disembarkation). In any case, the renter will have the right not to agree to the proposed alternative and choose to be reimbursed for the amount possibly already paid as a deposit, without however being able to request any compensation for further damages from the renter. OBLIGATIONS OF THE RENTAL COMPANY – The renter will make the vessel available to the renter in perfect conditions of cleanliness and efficiency, complete with all the safety equipment required for the type of navigation to be carried out, in compliance with current regulations and with legal insurance. In this regard, the lessor, by signing this contract, expressly declares to have taken out all insurance as required by law. LIABILITY OF THE RENTAL COMPANY – The lessor is required to preserve and guard the property entrusted to him for rental with all diligence. In the event of breakdown, loss and/or damage to the vessel or its parts, occurring during the rental period and attributable to the conduct of the lessor, even if caused by third parties, without prejudice to force majeure, the lessor must reimburse the lessor for the cost necessary for the repair or recovery of the property or its parts. The lessor will not be personally liable for any damage to persons, animals or things caused by the use of the vessel, especially if caused by other subjects or by bad weather or sea conditions. UNEXPECTED FAULTS OR DAMAGES – In the event of unforeseen or unforeseeable faults or damage to the vessel, without prejudice to the case referred to in the previous art.8, the lessor undertakes to make the time necessary for repairs as short as possible. No compensation for damages may be requested. CHARACTERISTICS AND CONDITIONS OF CRUISE – The lessor declares that he has been informed by the lessor, and therefore that he is fully aware, of the characteristics of a pleasure vessel and of the methods and conditions of a cruise on it, of the living spaces and of the maximum number of people that the vessel can carry. PROTECTION OF PERSONAL DATA – Pursuant to art.13 of EC Regulation no. 2016/679 containing provisions on the protection of personal data, the Company, as data controller, informs that the personal data provided by the passenger will be processed for purposes strictly related to the management of the contractual relationship and the provision of services, also by means of information systems, suitable to guarantee their security and confidentiality. COMPLAINTS – The passenger, if he detects deficiencies or irregularities in the service provided, can notify the Captain on board. COMPETENT COURT – The parties expressly declare that for any and all disputes arising from this contract, a mediator chosen by the owner will be competent in the first instance and only subsequently is it agreed that the competent court is the Court of Torre Annunziata. APPLICABLE RULES – For anything not provided for in this contract, the parties expressly refer to the rules of the Navigation Code, the Civil Code and the applicable Italian laws. Capri fee: 100 euros for Charter to be pay in port Sorrento fee: 10 euros for person to be payed in port Positano fee: 10 euros for person to be payed in port Snorkeling equipment new: 25 euros for person if needed
