Only rental for the inland waters of Friesland-Overijssel-Groningen NOTE: Deposit/own risk is €600 (to be paid when picking up the boat) Summary of the RENTAL CONDITIONS CONFIRMATION The rental agreement must be completed and signed by the tenant within 5 days, together with a copy of the boating license if requested, and returned to the lessor. PAYMENT The total rental amount does not include the security deposit. must be paid to the lessor at the start of the rental period. LIABILITY The tenant does not hold the lessor liable for any personal or material damage suffered by the tenant. The tenant does not hold the lessor liable for any claims made by third parties. TERMINATION OF THE LEASE. The lessor reserves the right to take a mandatory SSH course (SchipperStartHulp) and/or to immediately terminate the rental agreement in the event of proven incompetence with regard to sailing and/or navigating the vessel by the tenant, without the lessor being liable to pay any compensation and/or refund the rental amount to the tenant. AVAILABILITY The tenant must identify himself to the lessor before departure by means of an identification document (e.g. passport or driver's license). The vessel is made available clean and with full water, gas and fuel tanks. The tenant is obliged to pay the rent and deposit due, or cancellation costs, even if he does not use the vessel or uses it for a shorter period. RETURN At the end of the rental period, the renter must refuel the ship at the lessor. The renter must return the ship to the home port in good time, before the end of the rental period, in the same condition (except for wear and tear) as at the start of the rental period. The renter must return the boat tidy and swept clean. Any damage that occurs during the rental period must be reported to the lessor by the renter. The damage will be deducted from the deposit. Any material lost during the rental period must be compensated by the renter. SAILING AREA The sailing area includes the insurance area determined by the insurance. Namely: Inland waters of Friesland – Overijssel - Groningen with the exception of the major rivers. and IJsselmeer – Markermeer – IJmeer - Waddenzee – Zwarte meer – Ketelmeer - In the event of violation of the sailing area, the lessor may immediately take possession of the vessel, without refund of the rental fee and withholding the deposit. Extension of the sailing area is only possible if this has been agreed in writing with the lessor DAMAGE OR BREAKDOWN In the event of any damage, breakdown, damage, seizure and damage to the vessel, inventory and accessories, the renter must contact the lessor as soon as possible. DEFICIENCIES If one of the parties fails to fulfil its obligations, the other has the right to terminate the contract in whole or in part. This is only different if the deficiencies are of such a special nature or minor extent that termination is not justified. There is also a claim for compensation for any damage, unless the deficiency cannot be attributed to the other. The lessor's liability in the event of a breach is limited to a maximum of the rental sum paid by the lessee. If the lessee returns the vessel later than agreed, the lessor is entitled to a proportional increase in the rental sum and compensation for further damage, unless the late return cannot be attributed to the lessee. APPLICABLE LAW AND DISPUTE RESOLUTION This rental agreement is subject to Dutch law. Only the Dutch court or the dispute resolution body established in the Netherlands by both parties is authorized to hear disputes.
