All renters must agree to the following: - Be at least 18 years of age to operate the jet ski - Provide valid government issued photo ID  - Sign Liability Waiver  - Agree to the Terms of Use provided below (NOTE: Booking confirmation is evidence of your agreement to the Terms of Use) - Provide a $500 security deposit (fully refundable at the end of your rental period barring no damages to the equipment). This deposit may be applied to the following:- Minor damages  - Cleaning fees - Gas fees - Additional time tacked on to a rental  - Any other charges agreed upon by us and the customer during the trip **************************************** JET SKI RENTER'S TERMS OF USE AGREEMENT Responsibility of the Renter The renter agrees to take full responsibility for the operation and safety of the jet ski during the rental period. The renter acknowledges that he or she is fully qualified and able to operate the jet ski, and will comply with all applicable laws and regulations. Rental Period The rental period begins at the agreed-upon time and ends at the agreed-upon time. The renter must return the jet ski to the rental location by the agreed-upon time, or be subject to additional charges. Rental period requires an hourly minimum as follows: - 2-hr minimum required if within 15mi of Oceanside Harbor - 3-hr minimum required if 16 - 35mi of Oceanside Harbor - 36 - 40mi (maximum) of Oceanside Harbor requires FULL DAY RENTAL @$500 Payment The renter agrees to pay the full rental fee and security deposit, as well as any additional charges for damages or late returns. Payment must be made in full at the time of rental. Safety The renter agrees to wear a personal flotation device (PFD) at all times while operating the jet ski. The renter also agrees to operate the jet ski in a safe and responsible manner, and to avoid any reckless or dangerous behavior. Damage and Liability The renter acknowledges that he or she is fully responsible for any damages to the jet ski during the rental period. The renter also agrees to indemnify and hold harmless the rental company from any claims or damages arising from the renter's use of the jet ski. Cancellation Policy The renter may cancel the rental agreement at any time prior to the start of the rental period. However, the rental company reserves the right to retain a portion of the rental fee as a cancellation fee as follows: - 10% cancellation fee up to 7 days prior to reservation - 25% cancellation fee up to 3 days prior to reservation Governing Law This agreement shall be governed by the laws of the state in which the rental takes place; CALIFORNIA. Entire Agreement This agreement constitutes the entire agreement between the renter and the rental company, and supersedes all prior agreements and understandings, whether written or oral. By confirming your reservation through this platform, the renter acknowledges that he or she has read and understood this agreement, and agrees to be bound by its terms and conditions.
