GENERAL CONDITIONS 1-Terms of payment: The term of this agreement is subject to the payment of the booking amount. A- Booking will be effective upon receipt for MedCaribbean Charters, Ltd for the 50% of the total rental price. B- The balance of the lease, the remaining 50% must be paid 60 days prior to shipment. C- Failure to pay will result in the cancellation of the contract, leaving as compensation to the lessor the amounts paid. 2-Cancellation: - In case of cancellation 90 days before shipment, client will get back 50% of the total amount paid. - In case of cancellation less than 90 days prior to shipment, client will not be refunded. Notwithstanding the foregoing, no refund or compensation will be paid if your charter is cancelled due to unusual and unforeseeable circumstances beyond our control, the consequences of which cannot be avoided even if all due car had been exercised; such as (by way of example), natural disaster, fire, adverse weather conditions, acts of God, hurricanes or any other similar events or unforeseen circumstances that may amount to force majeure. 3-Deposit: The day of shipment the lessee shall deliver to the lessor the deposit as indicated in the general conditions that respond to faults, cracks, damage, theft, delays in returning the boat (penalty of $200 per hour), differences in inventory and equipment, compensation, misuse, neglect and penalties of any kind agreed in this contract or that may arise from the breach of it. This is without prejudice to legal actions that were coming to claim the amounts that exceeded that of the bond. The deposit can be withheld a maximum of 15 days after check out. 4-Insurance: The vessel is covered with an insurance policy with franchise, which is attached a copy one month prior to shipment. 5-Stock: Upon delivery of the vessel, both parties will proceed to check-in and related inventory. Once completed, contract will be signed and the corresponding supporting document of compliance and agreement. 6-Return of the boat: The boat must be returned in time and place to be determined by the particular conditions of this contract. The boat must be returned under identical operating conditions, equipment and inventory, same as the beginning of the lease. All damages that the damage or loss occur, assuming that is not covered by the insurance policy of the vessel, shall be paid by the lessee. In case of delay on return, lessee is obliged to pay the lessor the amount of 200$ for each hour of delay. 7-Damage to the vessel prior to the rental: In the event that the boat used to make the reservation would have a breakdown that precludes its lease prior to the reserved dates, the lessor in addition to putting the knowledge of the customer as soon as it has knowledge thereof, the cited shall be replaced by other similar boat as long as it should count with other boats available for it, otherwise, the company will reimburse the customer the full amount paid, lessor being relieved of any further compensation. 8-Damage to the vessel during the contract: Faults caused as a result of misuse of the vessel such as deterioration of furniture and utensils, sanitation and drainage obstructions, inter alia, that involves immediate repair and therefore the inability of the boat to be rented again, will cost the loss of the integrate amount of the deposit on behalf of the customer, claim expenses incurred as a result of such impairment by the injury. Among cases of maritime navigation, it is understood as improper use of the boat when a floating object in the water that may cause damage to the boat (as ropes, nets, hawser, etc.) and the ship's engine does not stop immediately to avoid possible faults, breakages or damage to the boat itself (hull, engine, transmission, propeller, etc). In the case that damages caused by the customer prevent the vessel from being re-rented, MedCaribbean Charters, Ltd will charge the customer double the deposit for loss of profits. The lessee shall not order any repairs without first having reported the fault to the lessor who will authorize the repairs. Failures due to negligence (scratches and bruises) or poor use of the vessel by the lessee, shall be paid by customer in its entirety, and the lessor will terminate the present contract and reserves the exercise of the claim for damages and the damage occurred. IMPORTANT : The dinghy and outboard engine must always be: - well tied to cleat in case of tow, mooring, anchorage or in general. In case the dinghy and outboard engine were not properly tied down or locked to the boat, pier or in general where it was left and there is loss or misplacement, MedCaribbean Charters will charge the charterer the deposit plus the $ 1500 penalty. * Before starting the holidays, we recommend our clients to take out a travel insurance with full coverage, including the boat, dinghy and outboard engine, as well as flights and possible stay (hotel). 9-Withholding administrative (capture and confiscation): Negligence or misuse of the boat, breaking the existing law by the lessee, will be sufficient motive for instant termination of the contract. In case of breach by the lessee of the ordinances of customs or any other administration, it will respond to all fines, penalties or liabilities to that could take place and all its consequences. In case of capture and confiscation of the vessel, the lessee shall pay to the lessor by way of compensation for damages caused by 15% of the vessel amount within thirty working days from the moment that this fact occurs. In all cases, the lessee will lose the quantities delivered for the benefit of the lessor. 10-Expenses: All expenditures for supplies, fuel, lubricants, ice, mooring in harbours and marinas, are the exclusive responsibility of the lessee. Fuel need to fill up at Nanny Cay before check out. In case of arriving at the marina without refuelling, MedCaribbean Charters, Ltd will charge a $ 150 penalty plus fuel. 11-License: The lessee shall submit together with the ID card or passport, the original title of sailing (navigation license) at the time of the embark. 12-User conditions: Lessee is responsible for all acts of the people named in the passenger list, which may not exceed in any case the maximum capacity of the boat. It is forbidden to use the vessel for the transportation of goods or travellers, other than those listed in the previous point, the shipment of weapons, animals, drugs or any toxic or hazardous substance. The lessee is obliged to use the boat exclusively as a charter boat or recreational tourism so that in no case it will be destined for trading transactions, commercial fishing, sports competitions, and any other inconsistent with the destination of the ship. The lessee has sole responsibility of the vessel during the lease and will use it responsibly, obeying the rules of the competitive authorities for the purpose, being solely and exclusively responsible for the consequences that will result from the breach of them. 13-Accidents: The Lessee agrees to immediately report any loss to the lessor and immediately transmit any letters, summonses or notices relating to this incident and to provide full cooperation to the lessor and the Insurer in the investigation and defense of any claim and trial. In case of theft of the boat, the lessee is required to submit the corresponding report on the matter before the competent authority and hand it to the lessor. 14- Lessee acknowledges his/her responsibility for the safe and proper operation of the craft; and for the safety and welfare of other boaters and persons. It is agreed and understood by lessee that lessor shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of rental craft. Lessee further agrees to indemnify and hold harmless the lessor from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said rental craft. Lessee further agrees to hold the lessor harmless should loss or damages occur to any of lessee´s personal property while in, or on, the rental craft, including loss or damage caused by fire, water, theft or any other cause whatsoever. 15- Lessee expressly agrees to indemnify and hold lessor harmless of, from, and against any and all loss, costs, damages, attorney less and/or liability in connection with the enforcing of the foregoing rental contract by Lessor, including expenses incurred in collection or attempting to collect delinquent rent and the event of suit by lessor to recover possession of said rented property and/or to enforce any of the terms, conditions and/or provisions hereof. It is understood and agreed that Venue of any action hereunder shall be in the county of Lessor. 16- In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental craft that lessee will immediately report same to lessor. Continued use of it shall be entirely at the lessee´s risk and thus lessee assumes all liabilities of injury and damage to all persons and property that may become involved by its continued use. 17-Jurisdiction: For the resolution of any disputes arising from this contract, the parties submit to the Administrative Authorities and Courts of Tortola, renouncing their own jurisdiction thereof.
