Terms and Conditions 1. In consideration of the agreement herein, our company (“LESSOR”) agrees to lease to the aforementioned signator (“LESSEE”) the vessel and equipment described herein. In the event the vessel is not returned at the time specified herein, LESSEE agrees to pay overtime at flat rate of Fifty Dollars ($50.00), due at opening of business on the following day. 2. LESSEE certifies they have examined the vessel and any and all additional equipment provided and find the condition acceptable and suitable for the personal use for which it has been leased. LESSEE agrees to maintain vessel and equipment in a safe and operable condition while in LESSEE’S custody. 3. LESSEE agrees to operate the vessel in accordance with all applicable safety rules and regulations as posted in this vessel and further assumes the responsibility that their guest(s) will abide by these rules. 4. LESSEE agrees to report any accident, malfunction, or damage to the rental boat to LESSOR immediately upon discovery or at the earliest feasible moment. LESSEE assumes the risk of continued use of a damaged or otherwise malfunctioning vessel and assumes all liability for injury or damage to all persons and/or property caused by its continued use. 5. LESSEE certifies they are capable of handling and operating a boat or vessel, such as the one referenced in this agreement. 6. LESSEE authorizes and allows LESSOR to charge LESSEE’S provided credit card for any damages or loss of equipment to the full extent allowed by law. 7. LESSOR will ensure all boats have a full tank of gas prior to each use. Additional refueling is at LESSEE’s expense, as posted. 8. A major credit card authorization or cash in the amount of two hundred fifty dollars ($250.00) shall be retained by LESSOR as partial compensation for failing to timely return said rental boat in as good condition, ordinary wear and tear excluded, as when received; or for reimbursement of articles damaged, missing, or broken. 9. LESSEE agrees not to use, nor permit the use: a. of the rental boat for any unlawful purpose; b. of the rental boat in a careless or negligent manner; c. of the rental boat while under the influence of alcohol or drugs; or d. By any other person not the signatory of the agreement, or not equally qualified. 10. LESSEE acknowledges their responsibility for the safe and proper operation of this vessel, and for the safety and welfare of other boaters, persons, and passengers. LESSEE agrees and understands that LESSOR, as well as any subsidiary or related entities associated with them shall not be held liable for damages, inconvenience, or time lost caused by accident, breakdown or malfunction of the rental boat. 11. LESSEE further agrees to indemnify and hold harmless LESSOR and its agents, affiliates, employees, personnel, subsidiaries and related entities from and against any and all claims . This includes but is not limited to, loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said rental vessel. LESSEE further agrees to hold LESSOR harmless should loss or damages occur to any of LESSEE’S personal property while carried in, on, or near the rental craft, including loss or damage by fire, water, theft or any other causes whatsoever. 12. LESSEE expressly agrees to indemnify and hold LESSOR and its agents, affiliates, employees, personnel, subsidiaries and related entities affiliates and personnel, harmless of, from and against any and all loss, cost, damages, attorney fees and/or liability in connection with the enforcing of the forgoing rental contract by LESSOR, including expenses incurred in connection with attempting to collect delinquent rent and in the event of suit by LESSOR, to recover possession of said rental property and/or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that Venue and any action hereunder shall be in the county of LESSOR. 13. LESSOR’S ability to provide a rental boat if reserved, is contingent upon and subject to the return of the unit by the previous lessee, satisfactory condition of the boat, weather, or any other cause beyond LESSOR’S control. LESSOR reserves the right to cancel this rental agreement and agrees to fully reimburse LESSEE for cancellations made under this provision. 14. Should any provision set forth in this Rental Agreement be held void or unenforceable, that term shall be deemed severed from this Agreement and the remainder of this agreement shall remain in full force and effect. 15. , liabilities, obligations, promises, causes of action, actions, suits, or demands, of whatsoever kind or character, known or unknown, suspected to exist or not suspected to exist, anticipated or not anticipated, arising from or related or attributable to this rental agreement with our company  This Agreement sets forth the entire agreement between LESSEE and LESSOR and supersedes any and all prior agreements or understandings, written or oral, between the parties pertaining to the subject matter of this Agreement. LESSEE acknowledges they are not relying on any other agreement or oral representations not fully expressed in this Agreement.
